(1) Money or other property found on the person or belonging to an undertrial prisoner, other than necessary wearing apparel, shall be taken charge of by the Naib Court, who is required to enter on the back of the prisoner’s warrant, a list of all such articles. In the case of a prisoner sentenced to imprisonment, the articles shall be forwarded to the prison to which he is committed. (2) A request of any prisoner to return the money belonging to him and lying with the prison authorities or part thereof, to enable him to pay for legal assistance, may be allowed and a receipt shall be taken from the prisoner. As and when the prisoner is released, his money shall be returned to him together with other property under proper receipt. Articles of clothing brought to prison by an undertrial prisoner shall be entered into the appropriate column of Register No. l (3) Excepting the clothes on his person, the papers of his case, the eatables and the drinking water provided by the prison authorities, the undertrial prisoner shall not be allowed to keep any other articles with him during transit for court production (4) The police escort shall not allow any eatables from outside or prohibited articles to be delivered to the undertrial prisoners during their journey to and from the court or on the court premises. (5) On return of an undertrial prisoner from the court, if any prohibited article is found or any irregularity is noted by the prison officer on duty, he shall forthwith report the matter to the senior officer on duty and if necessary, to the District Superintendent to Police for appropriate action. (6) When the presence of an undertrial prisoner confined in a prison is required in another case in which he is on bail, the court concerned shall duly intimate the prison authorities (7) If an under trial prisoner is released from the Court, he shall claim his personal property, if any, from the prison authorities within three months, failing which the same shall be disposed off as prescribed in rule 63.
