When an appellate court modifies a sentence passed by a lower court without change of section or when an appellate court passes a new sentence by changing the conviction section or the punishment section or otherwise, the sentence finally passed shall count, unless otherwise specially directed, from the date of imprisonment under the original sentence. Effect of two or more sentences. 144. (1) Provisions of sections 426, 427 and 428 of the Code of Criminal Procedure Code, 1973 (Central Act 2 of 1974) shall govern how two or more sentences inflicted at the same time or at different times, on the same person shall take effect. (2) When two or more sentences on separate trials are awarded to a person at the same time, the most severe sentence shall commence first followed by the next most severe and so on. For this purpose, the sentence of the same length of rigorous imprisonment shall be deemed more severe than the sentence of the same length of simple imprisonment: Provided that if life imprisonment is one of the sentences so passed, it shall commence last after the expiry of all the term sentences. Illustration 1.- When a person is sentenced to life imprisonment and term imprisonment/s on the same day, the sentence of term imprisonment shall commence first. Illustration2.- When a person is sentenced to five years rigorous imprisonment and four years rigorous imprisonment on the same day, the sentence of five years rigorous imprisonment shall commence first. Illustration 3.- When a person is sentenced to five years rigorous imprisonment and five years simple imprisonment on the same day, the sentence of five years rigorous imprisonment shall commence first. Illustration 4.- When a person is sentenced to five years simple imprisonment and four years rigorous imprisonment on the same day, the sentence of five years simple imprisonment shall commence first.
