(1) Whoever, without the consent of the owner or occupier or other person for the time being in-charge, affixes any posting bi I1 notice, playcard or other paper or means of advertisement against or upon any building, wall, tree, board, fence or pale or write upon soils, defaces or marks any such building, wall, tree, board, fence or pale, with chalk or paint or in any other way whatsoever, shall be punishable with a fine which shall not be less than twenty-Five rupees and more than two hundred , - rupees. (2) Notwithstanding anything conrained in section 243 a court may take cognizance of an offence under sub-section (1 1 of this section upon the complaint of the owner or occupier or other person in-charge of the property in respect of which such offences is a1 leged 10 have been committed.
