Section 249

Eldest of the spouses to be the head of the family

Eldest of the spouses to be the head of the family.— Where an inventory is instituted consequent upon divorce, separation or annulment of marriage, the head of the family shall, where the marriage is governed by the regime of community of assets, belong to the eldest spouse and where the marriage is governed by the regime of separation of assets, to the spouse who owns the assets; if there are any community assets, the eldest shall be the head of the family in respect thereof.
