Consequence of declaration of unworthiness to succeed.— (1) Once a person is declared as unworthy to succeed by a Court or is unworthy of succeeding as provided in sub- section (1) of section 10, the inheritance is deemed not to have devolved on him, and such person shall, for all purposes be considered a person in malafide possession of the assets. (2) In case of legal succession, the incompetence contemplated in sub-section (1) above does not affect the right of representation of his descendants.
