Penalties for breach of bye-laws.— 50(1) In making a bye-law under section 386, the Corporation may provide that a breach or any abatement of a breach of it shall be punishable. (a) with fine which may extend to ten thousand rupees and in the case of a continuing breach, with fine which may extend to one thousand rupees for each day during which the breach continues after conviction for the first breach, or (b) with fine which may extend to one thousand rupees for every day during which the breach continues after receipt of written notice from the Commissioner to discontinue the breach. (1) In making a bye-law under section 386, the Corporation may provide that a breach or any abatement of a breach thereof shall be liable to a penalty— (a) which may extend to one lakh rupees and, in the case of a continuing breach, to a penalty which may extend to ten thousand rupees for each day during which the breach continues after the first breach; or (b) which may extend to ten thousand rupees for every day during which the breach continues after receipt of written notice from the Commissioner to discontinue the breach.] (2) In lieu of or in addition to such fine 51[penalty], the Magistrate may require the offender to remedy the mischief so far as is in his power.
