Procedure in prosecution.— (1) No Court shall take cognizance of any offence under this Act or under any rule or bye-law made thereunder except on a complaint signed by the Commissioner, or by the officer in charge of a police station authorized by the Commissioner in his behalf either generally in regard to all such offences or particularly in regard only to specific offences or offences of a special class. --135-- (2) Notwithstanding anything contained in the Code of Criminal Procedure, 1973, it shall not be necessary in respect of any offence punishable under this Act to examine the complainant when the complaint is presented in writing.
