Execution of works which any person is required to execute by Commissioner at such person's cost.— (1) When any requisition or order is made under this Act or any rule or bye-law made thereunder, by written notice issued by the Commissioner or by any municipal officer duly empowered in this behalf, a reasonable period to be determined by the Commissioner shall be prescribed in such notice for --130-- carrying such requisition or order into effect. (2) If, within the period so prescribed, such requisition or order or any portion thereof is not complied with, the Commissioner may take such measures, or cause such work to be executed or things to be done, as may, in his opinion, be necessary for giving effect to the requisition or order so made; and unless it is in this Act or in any rule or bye-law made thereunder otherwise, expressly provided, the expenses thereof shall be paid by the person or any one or more of the persons to whom such requisition or order was addressed. (3) When a person is required under any provision of this Act or under any rule or bye-law made thereunder to supply any materials or fittings or to do any work, the Commissioner may, upon the requisition of such person in writing, supply the necessary materials or fittings or cause the necessary work to be done in this behalf: Provided that the said person shall first deposit a sum sufficient in the opinion of the Commissioner to cover the cost of the said materials, fittings or work. (4) When a person is required to execute any work under the provisions of this Act or under any rule or bye-law made thereunder, the Commissioner may, for reasons to be recorded in writing instead of giving him the option of executing it, cause such work to be executed by municipal or other agency under his own supervision, and may recover the expenses incurred thereby from the person liable to execute the work: Provided that the Corporation may, on the advice of the Commissioner, execute the work at the cost of the municipal fund.
