Provision of stand by generator: The owner and/or the keeper of the Nursing Home shall ensure the provision of stand by generator in case of the power failure in the nursing home. (As passed by the Legislative Assembly of the National Capital territory of Delhi on the 27.11.2002) An Act further to amend the Delhi Nursing Homes Registration Act, 1953. BE it enacted by the Legislative Assembly of the National Capital territory of Delhi in the Fifty-third Year of the Republic of India as follows:- Short title, 1. (1) This Act may be called the Delhi Nursing Homes Registration extend and (Amendment) Act, 2002. Commence- (2) It extends to the whole of the National Capital Territory of Delhi. Ment. (3) It shall come into force with effect from the date of its publication in the official Gazette. General .2. In the Delhi Nursing Homes Registration Act, 1953 (Delhi Act no. 6 of 1953) (hereinafter referred to as “the principal Act”), for the words “Chief Commissioner” and the words “Union territory of Delhi”, whenever they occur, the words “Lieutenant Governor” and the words “National Capital Territory of Delhi” shall respectively be substituted. Amendment 3. In the principal Act, in section 4, for sub-section (1), the of Section 4. following sub-section shall be substituted, namely:- “(1) Every person intending to carry on a nursing home shall make an application for registration and for renewal of registration every third year to the supervision authority.” Amendment 4. In the principal Act: in section 3:- of Section 5. (a) for sub-section (2), the following sub-section shall be substituted namely:- (2) A certificate of registration issued under this section shall subject to the provisions of section 7, be in force and shallbe valid until the 31st day of March of third year following the date on which such certificate was issued. (b) for sub-section (3), the following sub-section shall be substituted, namely (3) The certificate of registration issued for the specialty in respect of a nursing home shall be kept affixed in a conspicuous place in the nursing home. (C ) after sub-section (3) the following sub-section shall be inserted namely:- 17 (4) A nursing home registered under this Act shall not use the item “research centre”, against its name unless, it has the approval of the appropriate authority to carry out such research”. Substitution of (5) For section 6 of the principal Act, the following new section for section shall be substituted, namely section 6 “6 whoever contravenes the provisions of section 3 shall on conviction be punished with fine which may extend to five thousand rupees, or, in the case of a second or subsequent offence, with imprisonment for a term which may extend to six months, or with fine which may extend to five thousand rupees, or, with both.
