Constitution of the Board and procedure. - (1) The Board shall consist of one member who shall be - (a) a Judge of the High Court, if the appeal preferred involves a claim exceeding ten thousand rupees; (b) a District Judge, if such appeal involves a claim which does not exceed ten thousand rupees. (2) Such appeal shall be disposed of according to the prescribed procedure. (3) The decision of the Board and, where no appeal has been preferred to the Board, the decision of the Claims Officer shall be final. CHAPTER V Assessment of compensation [19. Appointment of Compensation Officer. - The State Government shall appoint one or more officers to be designated as Compensation Officer, who shall in the case of an estate or tenure which has vested in the State under Section 3, of his own motion or on application by the outgoing proprietor or tenure-holder and, in the case of an estate or tenure which has vested in the State under Section 3-A, on receipt of an application on transfer by the Collector under clause (6) of Section 3-B, prepare in the prescribed form and in the prescribed manner a Compensation Assessment roll containing the gross asset and the net income of each proprietor and tenure-holder of estate and tenures and the compensation to be paid in accordance with the provisions of this Act to such proprietor or tenure holder and all other persons whose interests are transferred to the State under this Act together with such other particulars as may be prescribed: Provided that if in the case of a tenure created after the first day of January, 1946 the Compensation Officer receives from the Collector within three months of the date of vesting or the commencement of the Bihar Land Reforms (Amendment) Act, 1953, whichever is later, a report that an inquiry in respect of such tenure under clause (h) of Section 4 is pending, the Compensation Officer shall not prepare any Compensation Assessment roll until the expiry of three months from the date of the receipt of such report or until the receipt of the result of such inquiry from the Collector, whichever is earlier: and after the said period, unless the tenure has been annulled under clause (h) of Section 4, the Compensation Officer shall proceed to prepare the Compensation Assessment-roll in respect of such tenure.]
