Constitution of an Authority. - (1) The Government shall constitute and Executing Authority, initially for a period of one year, consisting of three members, including the Chairperson, for the purposes of deciding the claims of ex-gratia amount as well as the settlement charge. (2) The chairperson shall be a serving or a retired senior Government servant, having knowledge of matters related to revenue administration. (3) The Chairperson and the members of the Authority shall hold office till the pleasure of the Government. (4) The Authority for the purpose of this Act shall have the same powers as are vested in a Civil Court under the Code of Civil Procedure, 1908 (Act 5 of 1908) to issue commission, to hold local inspection, to summon and enforce attendance of witnesses and to compel production of documents. (5) The proceedings before the Authority shall be deemed to be judicial proceedings, within the meaning of Section-193 and 228 of the Civil Procedure Code.
