(1) The Government lands included in the Co-operative Colonisation Scheme or the Ex-servicemen Co-operative Colonisation Scheme sponsored by the Government of India may be assigned on registry to the colonist/occupant in accordance with these rules. (2) The licence granted to the Co-operative Colony in Form II of Appendix B of the Travancore-Cochin Co-operative Colonisation Scheme shall be cancelled by the assigning authority and the land resumed to the Government for assignment to the colonist/occupant. (3) When any land is resumed to the Government under sub-rule (2), the Deputy Registrar of Co-operative Societies having jurisdiction over the area shall, on application being made by the colonist/occupant fix the liabilities of the applicant to the Co-operative society concerned and shall furnish information thereof to the applicant and the co-operative society concerned and also the assigning authority. (4) On receipt of information by the colonist/occupant under sub-rule (3) the colonist/occupant may apply for assignment of the land referred to in sub-rule (3) on registry in the manner provided in Rule 12 of these rules. (5) The colonist/occupant applying for assignment of land under sub-rule (4), shall execute an agreement in the form given in Appendix I to these rules agreeing to discharge all his liabilities to the Co-operative Society concerned fixed under sub-rule (3) by paying the amount of such liabilities to the Government. (6) The assignee shall pay to Government the outstanding amount of loans advanced under Co-operative Colonisation Scheme with interest at 51/2, percent in ten equal half yearly instalments or in lump the first instalment being payable within 6 months from the date of assignment of the land. (7) All sums due to the Government under these rules shall in case of default be recoverable under the provisions of the Revenue Recovery Act for the time being in force as though they are arrears of land revenue. (8) Any outstanding dues to Government from the assignee shall be a first charge on the land granted on registry under these rules. (9) The assigning authority may, on satisfaction of the aforesaid conditions, assign the land to the colonist/occupant.
