When a defendant admits that money is due Payment in- from him to the plaintiff on account of rent, bu t pleads to Court of that the amount claimed is in excess of the amount money ad- due, the Court shall refuse to take cognisance of the ^uetoland- plea unless the defendant pays into Court the amount jorcje so admitted to be due.
