(1) When a defendant admits that money is due from him on account of rent, but pleads that it is due not to the plaintiff but to a third person, the Court shall refuse to take cognisance of the plea unless the defendant pays into Court the amount so adm itted to be due. Payment in to Court of money ad mitted to be due to third per son. (2) Where such a payment is made, the Court shall forthwith cause notice of the payment to be serv ed on the third person. (3) Unless the third person within three months from the receipt of the notice institutes a suit against the plaintiff an d therein obtains an ord er restraining pay ment out of the money, it shall be paid out to the plaintiff on his application. (4) Nothing in this section shall affect the right of any person to recover from the plaintiff money paid to him under sub-section (3).
