ln this Act, unless the context otherwise requires, Definitions. (a) "Boald" meanstheArunachal Pradesh Staff Selection Board constituted under section 3 ; (b) "Ghairpelson" means the Chairperson of the Board and includes an acting Chairman appointed bythe Government; (c) "Controller of Examinati#s" means the Controller of Examinations of the Board. (d) "Department" means a department of the Government and includes Organizations and autonomous bodies established/constituted by the Govern ment and Sem i- Govern ment Organizations. (e) "Direct recruitment" means the method of recruitment as provided under the rules regulating the recruitment to the subordinate services/ Group C posts ; 0 "Governor" means the Governor of the State of Arunachal Pradesh; (g) "Government" means the Government ofArunachal Pradesh ; (h) "Member" means a member of the Board ' 2 TheArunachal Pradesh Extraordinary Gazette, october 3, 2018 (i) "notification" means a notification published in the Official Gazette of the Government; (J) "Official Gazefte" means the Official Gazette of the Government ofArunachal Pradesh ; (k) "Prescribed" means prescribed by rules made under thisAct ; (l) "Regulations" means regulations made by the Board under section 23 ot this Act ; (m) (n) (o) "Secretary" means the Secretary of the Board ; "State" means the State ofArunachal pradesh ; Constitution of the Board. Appointment, terms of office and conditions of service of the Chairper- son and mem- bers. Off icer and other Employ- ees of the Board, Duties and functions of the Board. "subordinate services/posts" means all Group "C" posts in the Government Departments, organizations and autonomous bodies established/ constituted by the Government and Semi-Government Organizations and includes such other services/posts as may be notified by the Government to be subordinate seruices/posts, but shall not include the tenure posts which are created for the Office of the Chief Ministeri Minister, Leader of opposition, Advocate General and all other tenure posts wherein the Government makes appointments. 3 (1) The Government shall, by notification in the Official Gazette, constitute a Board to be called the "Arunachal Pradesh Staff Selection Board" to exercise the powers conferred on it and to perform the functions assigned to it, under this Act. (2) The Board shall consist of, (a) AChairperson, who shall be an officerfrom the lndian Administrative Service in the pay not below that of Supertime scale; (b) two rnembers, who shall be otficers of the Government, or taken on deputation, in the pay scale not below that of Selection Grade; (c) a Controller of Examinations, who shall either be an officer of the Government, or taken on deputation, in the pay scale not below that of Selection Grade', (d) a Secretary, who shall be an otflcer of the Government in the pay scale not below Senior scale. 4 (1) The Chairperson and other members of the Board shall be appointed by the Governor and shall hold office during his pleasure. (2) The normal tenure of the members of the Board shall be two years. Provided that a member who is appointed on deputation, may be of three years extendable to five years 5 (1) The Government shall provide the Board with such other officers and employees as may be necessary for the efficient performance of the functions of the Board under this Act. (2) The salaries and allowances payable to, and the other terms and con- ditions of service of, the members, officers and other employees of the Board, shall be such as may be prescribed. 6 (1) Notwithstanding anything contained in any other law for the time being in force it shall be the du$ of the Board to conduct examinations jnd select candidates for appointments to the subordinate services/posts. (2) lt shall be the duty of the Board to perform such other functions and duties as the Government may, by notification, specify. (3) lt shalt be the duty of the Board to conduct departmental examinations and advice the Government in such matters and on such other matters as may be referred to it by the Government. (4) Notwithstanding anything contained in any other law forthe time being in force, or rules, regulations, bye laws framed thereunder, relating to the appointment to the serviceslposts in, and conditions of service of employees of, the Government Departments, organizations and autonomous bodies established/ constituted by the Government and Semi-Government Organizations, the Board shall be the authority competent to conduct examinations for appointments to the sub- ord i nate services/posts of such Govern ment Departments, organ izations and autonomous bodies and Semi-Government Organizations, and it shall be the duty of the Board to conduct such examinations. 3 TheArunachal Pradesh Extraordinary Gazette, october 3, 201g 7 (5) On all matters relating to methods of recruitment to, or any other matter relating to, the subordinate services/posts it shall be the duty of the Board to advise on any matters so referred to by the Government Department, an organization or autonomous body established/ constituted by the Government, or a Semi-Government Organization. (6) The Government may, howeve[ make orders specifying the matters in which either generally or in any particular class oicases or in any particular circumstances, it shall not be necessary for the Board to be consulted. (7) ln the case of any difference of opinion between the Board and the Government Department, or an organization or autonomous body established/constituted by the Government, or the Semi-Government organizations, or on any other matter, the concerned Government Department, or an orginasation or autonomous body, or the semi- Government organiasation, shall refer the matter to the Depariment of Administrative Reforms, Government of Arunachal pradesh and the decision of the Government thereon shall be final. The Chairman, as administrative head of the Board, shall be responsible for - (a) ascertaining well in advance but not less than one year, from the departments, the nurnberof posts forwhich recruitment is to be made, from time to time; (b) inviting applications by means of advertisements; (c) scrutinizing applications received in response to advertisements, (d) responsibility for engaging confidential printer and for getting question papers prepared, (e) conducting of competitive examination for the candidates ; (0 selection and preparation of merit list of the successful candidates ; (g) recommending to the departments concerned names of selected candidates : (h) maintaining records of selections by the Board ; (i) any other duty, or duties, entrusted to the Board by the Government, from time to time. The members shall assist the Chairman in conduct of the examinations and perform other such duties as directed or delegated by the Chairman.
