(1) The Chief Municipal Executive Officer/Municipal Executive Officer may, by a general order, or by a especial order affecting such portion of the municipal area as may be specified therein, prohibit- to urban environmental management and submission of report on environmental status of municipal area. (a) the making of excavation for the purpose of taking earth there from or strong rubbish or offensive matter therein or (b) the digging of cesspool, tanks, ponds, wells or pits, without his special permission. (2) No persons shall make any excavation referred to in clause (a), or dig any cesspool, tank, pond, well, or pit referred to in clause (b), of sub-section (1) in contravention of any such order. (3) If any such excavation is made, or any such cesspool, tank, pond, well or pit is dug in contravention of the order under sub-section (1), the Chief Municipal Executive Officer/ Municipal Executive Officer may, by notice, in writing, require the owner or the occupier of the land, on which such excavation is made or such cesspool, tank, pond, well or pit is dug, to fill it up with earth or other material approved by him.
