Upon the receipt of any such report' the Magistrate shall take such measures as may be necessary for the trial of the accused and the disposal of the property according to law: [Provided that before passing any order for disposal of property, the Magistrate shall satisfy himself that no intimation under sub-section (5) of Section 49 has been received by his court or by any other court having jurisdiction to try the offence on account of which the seizure of the property has been made]. *{Insert of new proviso by 2005 (Amd) Act (Act no 2 of
