Cognizance of offences:- (1) Notwithstanding anything contained in the Code of Criminal Procedure, 1973,- no court shall take cognizance of an offence punishable under the Act and the Rules made there under, except upon a complaint, in writing, made by (i) The Milk Commissioner; (ii) Any other Officer authorized in his or her behalf by the Milk Commissioner by General or Special order; (iii) Any person aggrieved; (2) No court inferior to that of a Metropolitan Magistrate or a Judicial Magistrate of the first Class shall try any offence punishable under the Act and the Rules made there under.
