Prosecution, Magistrate’s power etc., - (1) No prosecution for any offence punishable under this Act shall be instituted except with the previous sanction of the Metropolitan Commissioner / Vice-Chairperson. 96 (2) No Court inferior to that of a Magistrate of the first class shall try an offence punishable under this Act. Any proceedings in respect of an offence under this Act or any regulations made there under shall be tried summarily. (3) Notwithstanding anything contained in section 32 of the Code of Criminal Procedure, 1973, (Act. II of 19740 it shall be lawful for any court of a Magistrate of the first class to pass any sentence authorized by this Act in excess of its power under the said section.
