Prosecution Magistrate’s Power etc

Prosecution Magistrate’s Power etc., - (1) No prosecution for any offence punishable under this Act shall be instituted except with the previous sanction of the Commissioner. (2) No Court inferior to that of a Magistrate of the first class shall try an offence punishable under this Act. Any proceedings in respect of an offence under this Act or any regulations made thereunder shall be tried summarily. (3) Notwithstanding anything contained in section 32 of the Code of Criminal Procedure, 1973 (Act No.11 of 1974), it shall be lawful for any court of a Magistrate of the first class to pass any sentence authorized by this Act in excess of its power under the said section.
