JUSTICE R.K. PATTANAIK Order No. ORDER 21.04.2026 01. 1. Heard learned counsel for the respective parties. 2. Instant petition has been filed under Section 482 BNSS by the petitioner seeking pre-arrest bail in connection with G.R. Case No.515 of 2023 pending in the file of learned SDJM, Jagatsinghpur, arising out of Biridi P.S. Case No.95 of 2023 on the grounds stated. 3. Perused the F.I.R. as at Annexure-1. Recorded the submission of Mr. Das, learned counsel for the petitioner with reference to the F.I.R. It is claimed that the Hall Ticket serial number was found to be fake and not genuine, hence, the F.I.R. The petitioner is a teacher by profession and had admittedly approached this Court once before vide ABLAPL No.3295 of 2023 disposed of on 14th August, 2023, a copy of which is at flag-A. It is informed to the Court by Mr. Das, learned counsel that the investigation is still not concluded. It is submitted that the original certificate is not fake but only the serial number Kabita mentioned therein as alleged. Recorded the objection of the State. The F.I.R. was lodged in the year 2023. Immediately after the report was lodged, the petitioner moved this Court for anticipatory bail but it was declined. But considering the submission of Mr. Das, learned counsel that the investigation is still not concluded, this Court, having recorded the objection of the State but for the reason that even after nearly two and half years, the investigation is underway and the petitioner being a teacher and a lady, is inclined to direct her to surrender before the learned court below for being released with conditions instead of entertaining her plea for pre-arrest bail. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL is disposed of with the direction as aforesaid. In the event, the petitioner surrenders before the court of learned SDJM, Jagatsinghpur, within a month from today, it is directed that she shall be released on bail in connection with G.R. Case No.515 of 2023 corresponding to Biridi P.S. Case No.95 of 2023 on furnishing a bail bond of Rs.30,000/-(rupees thirty thousand) with one solvent surety for the like amount with such other conditions imposed by the court concerned as deemed just and proper in the facts and circumstances of the case. 6.
