1. Heard learned counsel for the petitioners and State.
2. Instant petition has been filed under Section 482 BNSS by the petitioners seeking pre-arrest bail in connection with Banki P.S. Case No.481 of 2025 corresponding to G.R. Case No.569 of 2025 pending in the court of learned S.D.J.M., Banki on the grounds stated.
3. The ABLAPL stands dismissed for being infructuous as against petitioner No.5 recording the submission of learned counsel for the petitioners with reference to a bail order in BA No.1499 of 2025 of the court of learned Sessions Judge, Cuttack dated 22nd December, 2025. In respect of petitioner Nos.1 to 4 and 6, it is submitted that they should be granted bail in view of the release of the co-accused persons. Recorded the objection of the State. But, in view of the order in the earlier ABLAPL at Flag-A, the Court is not inclined to reconsider the
bail plea of the petitioners, however, grants liberty for them to surrender before the court below seeking regular bail.
4. Accordingly, it is ordered.
5. In the result, the ABLAPL is disposed of with the direction as aforesaid. It is further directed that in the event, petitioner Nos.1 to 4 and 6 surrender before the court of learned S.D.J.M., Banki within a fortnight from today in connection with Banki P.S. Case No.481 of 2025 corresponding to G.R. Case No.569 of 2025 and move regular bail, it shall be duly considered and in case rejected during the first hour, they shall approach the learned Sessions Court during the second hour for orders on the same day on the plea of release of the co-accused persons and for the said purpose, the lower court record shall be made available at the time of hearing.
6. Issue urgent certified copy of this order as per rules.
