For Petitioner : Dr Lakshmi Prasanna Komara For Respondents : Mr.A.Thiruvadi Kumar Additional Public Prosecutor O R D E R [Order of the Court was made by N.ANAND VENKATESH, J.] This Writ Petition has been filed challenging the proceedings of the first respondent made in No.1136/Utha.2/2025, dated 23.02.2026, wherein the first respondent, while granting 28 days of ordinary leave, imposed a condition that the detenue shall be accompanied by an escort. 2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondents. ____________ https://www.mhc.tn.gov.in/judis W.P.CRl..(MD).No.2096 of 2026 3. The petitioner's brother is a life convict, who is presently serving sentence at Central Prison, Madurai. The petitioner made a representation seeking ordinary leave and the same was considered and granted by the first respondent through proceedings in No.1136/Utha. 2/2025, dated 23.02.2026. However, while granting ordinary leave, a condition was imposed to the effect that the detenue shall be accompanied by an escort. This condition is put to challenge. 4. In our considered view, the condition imposed by the first respondent can be modified to the extent that the detenue shall report before the 4th respondent daily at 6.00 PM during the entire period of ordinary leave. Apart from this condition, the detenue is permitted to submit the sureties before the Superintendent of Prison, Central Jail, Madurai, instead of executing the sureties before the Tahsildar and the two sureties shall be family members of the detenue.
