Mohanty and his associates have entered appearance by filing Vakalatnama on behalf of the Petitioners. Vakalatnama filed be placed on record. 2. The subject matter of this petition is substantially similar to the one in W.P.(C) No.5227 of 2025 between Union of India v. Tapan Kumar Pal heard and disposed off by this Bench vide judgment dated 10.02.2026. The operative portion of the order reads as under: “In the above circumstances, these petitions being devoid of merits are liable to be rejected and accordingly they are, costs having been made easy. By way of abundant caution, we make it clear that the benefit of the impugned orders is confined to the grant of terminal benefits which would obviously include ACP & MACP. Impugned orders of the Tribunal shall be implemented within an outer limit of three months.” 3. It hardly needs to be stated that in identical cases, identical relief has to be granted in the adjudicatory process, subject to all just exceptions into which argued case of the Petitioners do not fit. The above apart, learned counsel for the OP-Employee has placed on record Office Order dated 09.04.2026, whereby the above judgment has been implemented by granting benefit to the litigants therein. The said order reads as under: “ , OFFICE OF THE DIRECTOR OF CENSUS OPERATIONS, ODISHA Ministry of Home Affairs, Government of India No. No.92/2/2025-Estt/526 Date: 09-04-2026 OFFICE ORDER In pursuance of the Order dated 10.04.2024 passed by the Hon'ble CAT, Cuttack Bench, Cuttack in O.A. No. 158/2019, as upheld by the Hon'ble High Court of Orissa vide Order dated 10.02.2026 in W.P.(C) No. 5227/2025, and in accordance with the approval conveyed by the Office of the Registrar General, India, New Delhi vide Letter No. 13014/11/2022-Ad.IV dated 06.04.2026, the services of Shri Tapan Kumar Pal are hereby regularized from the date of his initial appointment to the post of Lower Division Clerk, i.e., w.e.f. 13.10.1980. This is issued with the approval of the Director. In the above circumstances, the Petition itself being devoid of merits is liable to be dismissed and accordingly it is, coupled with a direction to implement the impugned order within an outer limit of eight (8) weeks, as has been done in the case of similarly circumstanced employees, without driving the OP-Employee to take recourse to law for implementation.
