IN THE HIGH COURT OF ORISSA AT CUTTACK CRLMC No.2093 of 2026 Biswajit Giri @ Ganesh …. Petitioner(s) Mr. Bharat Jalli, Adv. versus- The State of Orissa …. Opposite Party(s) Smt. Sarita Moharana, ASC CORAM: HON’BLE DR.JUSTICE SANJEEB K PANIGRAHI Order No. 01. ORDER 08.07.2026 1. This matter is taken up through hybrid arrangement. 2. Case No.139 of 2022 pending before the Court of learned Special Judge, Keonjhar, is granted, has prayed for quashing the impugned order dated 03.04.2026/Annexure-3 passed by the learned Special Judge, Keonjhar. 3. Heard. 4. Learned counsel for the Petitioner submits that the bail granted to the Petitioner has been cancelled due to violation of the terms and conditions imposed in the bail order. In her opposition, learned counsel for the State submits that the Petitioner has committed similar nature of offences after getting the bail order. She further contends that because of violation of the terms and conditions imposed in the said bail order, the bail granted to the Petitioner has been cancelled. She, accordingly, prays for dismissal of this CRLMC. 6. Considering the submissions made on behalf of both the parties, this Court is of the view that the Courts generally remain conservative in cancelling the bail. In the present context, the Petitioner has violated the terms and conditions imposed in the bail order, for which, the bail granted to him is cancelled. Since the Petitioner has committed similar offences after getting bail, this Court finds that the impugned order dated 03.04.2026 vide Annexure-3 does not suffer from any infirmity. This Court, therefore, declines to entertain the prayer made in this CRLMC. 7. This CRLMC is, accordingly, dismissed. (Dr. Sanjeeb K Panigrahi) Judge Ayaskanta Designation: Personal Assistant
