The present petition has been filed under Article 226 of the Constitution of India, 1950 read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as the ‘BNSS’) seeking the following reliefs: “(i) Issue an appropriate Writ, Order or Direction to the Ld. Magisterial Court presided over by Ms. Payal Singal, J.M.F.C.-09 (Central), Tis Hazari Courts, Delhi for disposal of the application U/s- 175(3) B.N.S.S., 2023 pending in the case bearing C.C. No.2442/2025 titled as “Gaurav Singh Vs. Prateek Nagrani & another” expeditiously within a time bound period; This is a digitally signed order. Learned counsel for the petitioner submits that the petitioner’s application under Section 175(3) of the BNSS, pending in Complaint Case No. 2442/2025 titled “Gaurav Singh v. Prateek Nagrani & Another”, has been pending since 26.12.2025. He further submits that despite completion of the enquiry, neither has the State filed the status report before the learned Trial Court nor has the learned Trial Court disposed of the said application. 5. Issue notice. 6. Learned ASC for the State, who appears on advance notice, submits that the enquiry has been completed and that an updated status report shall be filed before the learned Trial Court. Let the same be filed within a period of two weeks. 7. The learned Trial Court is directed to decide the application under Section 175(3) of the BNSS pending in Complaint Case No. 2442/2025 titled “Gaurav Singh v. Prateek Nagrani & Another”, preferably within a period of six months from the date of receipt of this order. 8. Accordingly, the petition stands disposed of. Pending application(s), if any, also stand disposed of. 9. A copy of this order be communicated to the learned Trial Court for information and necessary compliance. 10.
