JUSTICE R.K. PATTANAIK Order No. ORDER 21.04.2026 01. 1. Heard learned counsel for the petitioner and State. 2. Instant petition has been filed under Section 482 BNSS by the petitioner seeking pre-arrest bail in connection with Bhanjanagar P.S. No.1026 of 2025 corresponding to G.R. Case No.1705 of 2025 pending in the file of learned S.D.J.M., Bhanjanagar, Ganjam on the grounds stated. 3. Perused the FIR as at Annexure-1. It is claimed that no serious injury has been caused to the victim. While claiming so as to the nature of injury received by the victim, a copy of the order in BA No.400 of 2025 of the court of learned Additional Sessions Judge, Bhanjagar, Ganjam in respect of the petitioner is produced, wherein, he has been allowed to go on bail with conditions. It is informed to the Court by Mrs. Mohanty, learned ASC that the petitioner is having more antecedents. Considering the Ms. Mohapatra, learned counsel for the petitioner and State with reference to the order in BA No.400 of 2025 dated 16th October, 2025 of the learned Sessions Court and since it is made to reveal therein that there has been no grievous injury caused to the victim, this Court is inclined to extend parity as the petitioner is similarly situated like the co- accused, namely, Mantu Sethi, however, with a direction for him to surrender before the learned S.D.J.M., Bhanjanagar, Ganjam within the stipulated period for being released with conditions. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL is disposed of with the direction as aforesaid. It is further directed that in the event, the petitioner surrenders before the court of learned S.D.J.M., Bhanjanagar, Ganjam in connection with G.R. Case No.1705 of 2025 corresponding to Bhanjanagar P.S. No.1026 dated 7th September, 2025 within a fortnight from today, he shall be released on bail upon furnishing a bail bond of Rs.30,000/- (rupees thirty thousand) with one solvent surety for the like amount with such other conditions imposed as deemed just and proper in the facts and circumstances of the case. 6.
