By this application, the petitioner has prayed for bail in connection with Hajo Page No.# 2/3 P.S. Case No. 300/2026 registered under Section 305(a) of the BNS, 2023. The FIR in connection with which the petitioner has been arrayed as a accused person and was arrested lodged on 02.07.2026, wherein it was stated that the bike of the informant was stolen by unknown thief from the house of his brother in law. The police after registration of the case during investigation had recovered the said bike from the possession of the petitioner and arrested the petitioner and that the petitioner is in judicial custody for a period of 24 days till date. 3. The learned Counsel for the petitioner submits that the petitioner is of 20 years of age and that it is not the organized crime and also that he has been inside the jail for quite some days. 4. Mr. D.P. Goswami, learned Additional Public Prosecutor for the State submits that the bike was found in possession of the petitioner and it is also seen that there is attempt made to change the number of the said bike. He also had pointed out that the petitioner is a habitual thief as he would start the bike without the keys as has been stated in the forwarding report. 5. Upon consideration of the submissions made by the learned Counsels, more so, due to the fact that bike has been recovered and also that the petitioner has been inside the jail for almost a month, this Court finds it fit to enlarge the petitioner on bail on furnishing of bail bond of Rs. 20,000/- with local surety of the like amount to the satisfaction of Judicial Magistrate First Class, Hajo under the following conditions: i) if the petitioner is found indulging in such activities, the learned Court Page No.# 3/3 would be at liberty to cancel the bail. ii) the petitioner will appear before the Investigating Officer as and when call for. iii) the petitioner will not hamper, tamper with the evidence, neither influence the witnesses connected with the case. iv) the petitioners will not leave the place of jurisdiction without the permission of the said Court i.e. Judicial Magistrate First Class, Hajo. 6.
