1. This hearing has been done through hybrid mode.
2. The present petition under Article 227 of the Constitution of India seeks the following prayers:-
“a) Set-aside the impugned order dated 13.10.2025 passed in HMA No. 1498 o f 2019 by the court of Shri Sanjeev Kumar Aggarwal, Principal Judge - Family Court, East District Karkardooma Courts, Delhi;
b) Pass any other proper and further order (s) which this Hon'ble Court deems fit in the peculiar circumstances o f the present case in the interest of justice.”
3. Vide impugned order dated 13.10.2025, the learned Family Court closed the opportunity to lead evidence on behalf of the petitioner, who was respondent before the learned Family Court.

recording evidence of the present petitioner (Respondent before the learned Family Court) on 13.10.2025 for the first time. It is further submitted that the evidence affidavit was on record, however, the same could not be pointed out to the learned Principal Judge, Family Court, East District, Karkardooma, Delhi, at that point of time.

Learned counsel for the respondent fairly submits that he does not oppose the present prayer.
6. Let the respondent appear for cross-examination, before the learned Family Court.
7. In view of the above, the present petition is allowed, the impugned
order dated 13.10.2025 is set aside.
8. The respondent affidavit is already on record.
9. The petitioner (Respondent before the learned Family Court) shall appear before the learned Principal Judge, Family Court, East District, Karkardooma, Delhi, for the cross-examination on 20.05.2026. The aforesaid date is being given at the consent of the learned counsel for the parties.
10. The present petition is disposed of.
11. Pending application(s), if any, also stands disposed of.
