Page 1 of 3. IN THE HIGH COURT OF ORISSA AT CUTTACK WP(C) No.2085 of 2026 Narayan Swain and others ..... Petitioners Represented by Adv. - Soma Patnaik -versus- State Of Odisha and others ..... Opposite Parties Smt. S. Nayak, ASC CORAM: THE HON’BLE MR. JUSTICE ADITYA KUMAR MOHAPATRA ORDER 20.01.2026 Order No. 01. 1. This matter is taken up through Hybrid mode. 2. Heard learned counsel for the Petitioner as well as learned counsel for the State-Opposite Parties. Perused the writ application as well as the documents annexed thereto. 3. The Petitioner has filed the present writ application with the following prayer: “Under these circumstances, the petitioners most humbly pray that this Hon'ble Court may be graciously pleased to issue a Rule Nisi calling upon the opposite parties to show cause as to why: i)The opposite party university shall not be directed to regularize the petitioners Page 2 of 3. with effect from the date of appointment. If the opposite parties fail to show cause or show insufficient cause the Rule Nisi be made absolute. And further be pleased to pass any other appropriate writ/writs, order/orders, direction/directions as this Hon'ble Court deems fit and proper for ends of justice,” 4. It is stated by learned counsel for the Petitioners that although the Petitioners are eligible to have their services regularized their services at par with other similarly situated employees, who have already been regularized by virtue of order dated 10.07.2025 at Annexure-4, however, the case of the Petitioners has not been considered by the Opposite Parties. Being aggrieved by such illegal and discriminatory conduct on the part of the Opposite Parties, the Petitioners have approached this Court by filing the present writ petition for a direction to the Opposite Parties to regularize their services at par with similarly situated employees, whose services have been regularized. On perusal of the record, it appears that the Petitioners have approached the Opposite Party No.2 by filing a detailed representation dated 19.12.2025, the same is also supported by the postal receipt. 5. In such view of the matter, this Court is of the view that in the event the representation filed by the Petitioners is still pending and no final decision has been taken thereon by the Opposite Party No.2, the same be considered by the Opposite Party No.2 keeping in view the fact that the similarly situated persons have already been regularized. In view of the aforesaid position, this Court disposes of Page 3 of 3. the writ application directing the Opposite Party No.2 to consider the grievance of the Petitioners as involved in the representation dated 19.12.2025 at Annexure-3 within a period of eight weeks, taking into consideration the fact that similarly situated persons have been regularized and the order dated 10.07.2025 at Annexure-4. The representation of the Petitioners shall be disposed of by passing a speaking and reasoned order. The decision so taken be communicated to the Petitioners within ten days thereafter. 7. With the aforesaid observations/directions, the writ application stands disposed of. Issue urgent certified copy of this order as per Rules. ( Aditya Kumar Mohapatra ) Judge S.K. Rout
