1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).
2. Since these two bail applications arise out of one and same case record, the same are heard together and
disposed of by this common order with the consent of the learned counsel for the parties. 3. These are the bail applications U/S.483 of BNSS by the petitioners for grant of bail in connection with Patnagarh PS Case No.322 of 2025 corresponding to GR Case No.1288 of 2025 pending in the file of learned SDJM, Patnagarh, being charge-sheeted for commission of offences punishable U/Ss.331(4)/127(2)/311/61(2) of BNS, on the main allegation of committing dacoity in the house of the informant by assaulting her and her son and taking away cash of Rs.5,00,000/- and gold ornaments. 4. Heard, Mr. Suryakanta Dwibedi, learned counsel for both the BLAPLs and Mr. C. Mohanty, learned Addl. PP in these matters and perused the record. 5. Admittedly, FIR has been lodged against unknown persons, but subsequently, the petitioners have been charge-sheeted in this case along with co- accused persons, however, the petitioners are in custody since 02.11.2025/21.05.2026 and no TI parade has been conducted to identify the suspects. Further, there being no criminal antecedent reported against any of the petitioners except three cases against the petitioner- Dhaneswar Nag which is before the year 2024. In the aforesaid circumstance and taking into account materials placed on record and keeping in view the other circumstances on record in entirety including the inherent right of the accused to be presumed innocent until proven guilty at the trial and the grant of bail to co-accused persons Rohita Saraf (in BLAPL No.12402 of 2025), Ganesh Bhue (BLAPL No.12663 of 2025), Mahadev Chand @ Mahadeb Chand (in BLAPL No.12777 of 2025) and Rahul Kumbhar (BLAPL No.13065 of 2025), this Court without expressing any view on merits admits each of the petitioners to bail. 6.
6. Hence, these two bail applications of the petitioners namely Dhaneswar Nag (In BLAPL No.2082 of 2026) and Sashikanta Muna (In BLAPL No.5584 of 2026) are allowed and each of the petitioners are allowed to go on bail on furnishing bail bonds of Rs.50,000/- (Rupees
Fifty Thousand) with one solvent surety for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper by it with following condition:-
(i) the petitioners shall report attendance before the jurisdictional Police Station once in a fortnight preferably on a Sunday in each month in between 10 A.M. to 12 Noon for three(03) months from the actual date of release from the custody. 7. The I.I.C. of Jurisdictional Police Station shall not detain the petitioners unnecessarily after recording their attendance beyond the time as stipulated. 8. Accordingly, these BLAPLs stand disposed of. A soft copy of this order be immediately communicated to the concerned Court, who shall afterwards communicate the same to the concerned Jail through e-mail for reference. (G. Satapathy)
