Panda, ASC CORAM: MR. JUSTICE R.K. PATTANAIK Order No. ORDER 21.04.2026 01. 1. Heard learned counsel for the petitioner and State. 2. Instant petition has been filed under Section 482 BNSS by the petitioner seeking pre-arrest bail in connection with Chauliaganj P.S. Case No.262 of 2020 corresponding to G.R. Case No.838 of 2020 pending in the file of learned J.M.F.C.- IV, Cuttack on the grounds stated. 3. Perused the FIR as at Annexure-1. The petitioner had earlier approached this Court in 2020 vide ABLAPL No.10991 of 2020 at Flag-C and disposed of by order dated 19th October, 2020. It is submitted to the Court that the investigation was concluded after the earlier rejection order in the ABLAPL with the filing of the chargesheet dated 8th December, 2020. A copy of the chargesheet is produced by the learned counsel for the petitioner at the time of hearing along with the chargesheet. The statements of the witnesses recorded during investigation are also made available. A copy of the order of cognizance dated 9th December, 2020 is filed for the Court’s perusal. In course of hearing, the State has also submitted the case diary, chargesheet and other police papers. The Court finds that in course of events, the accused persons removed a four-wheeler and mobile handset from the possession of the informant but according to the chargesheet, such seizure of the vehicle was made from another accused, namely, Ratnakar Rout. Considering the above facts and submission of chargesheet later to the rejection order in the ABLAPL of the year 2020 and till date, the petitioner could not be arrested since shown as an absconder therein, this Court, in the changed circumstances, is inclined to direct him to surrender before the learned court below to go on bail with conditions. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL is disposed of with the direction as aforesaid. It is further directed that in the event, the petitioner surrenders before the court of learned J.M.F.C.-IV, Cuttack in connection with Chauliaganj P.S. Case No.262 of 2020 corresponding to G.R. Case No.838 of 2020 within a fortnight from today, he shall be released on bail upon furnishing a bail bond of Rs.30,000/-(rupees thirty thousand) with one solvent surety for the like amount with such other conditions imposed as deemed just and proper in the facts and circumstances of the case. 6. 6.
