WMP No. 2082 of 2019 ORDER This impleading petition has been filed seeking to implead the petitioner herein as party respondent in W.P.No.30474 of 2018. 2.Learned counsel for the petitioner would submit that the petitioner is the owner of Flat.No.23, Risikesh Apartment, Old No.38, New No.75, G.N.Chetty Road, T.Nagar, Chennai – 600 017 to an extent of 1498 sq.ft in second floor. The 1st respondent/petitioner in main W.P.No.30474 of 2018 was residing as a tenant in the aforesaid petitioner’s property. While so, according to the petitioner herein, the writ petitioner has fraudulently executed a sale deed in his favour in respect of the subject property through a Power Agent in Doc.No.1173 of 2018 dated 04.05.2018. In this regard, a criminal complaint has been lodged against the writ petitioner. The main writ petition has been filed seeking for a direction to release the aforesaid sale deed dated 04.05.2018, which would allow the petitioner to commit further fraud. However, the main writ petition itself has been dismissed as withdrawn as early as on 29.01.2019. 3.In view of the above, since the main writ petition has been withdrawn, the prayer sought for in this writ miscellaneous petition has become infructuous. WMP No. 2082 of 2019 Registrar, the 3rd respondent herein is directed to issue notice to the petitioner herein if the 1st respondent attempts to register or transact the subject property, so as to avoid further fabrications and fraud, until the completion of the pending criminal proceedings initiated by the petitioner herein. 4.With the aforesaid observation, this writ miscellaneous petition stands closed. No costs.
