Instant petition has been filed under Section 482 BNSS by the petitioner seeking pre-arrest bail in connection with Barpali P.S. Case No.55 of 2026 corresponding to G.R. Case No.54 of 2026 pending in the file of learned J.M.F.C., Barpali on the grounds stated. 3. Perused the FIR as at Annexure-1. The report was lodged by the local PS for illicit transportation of sand in a vehicle. Learned counsel for the petitioner submits that the said vehicle belongs to the petitioner. It is further claimed that the petitioner does not have any antecedent but apprehends arrest in the hands of the local police on account of the disclosure made by the driver of the vehicle. Recorded the objection of the State. Since it is claimed that the petitioner is the first-timer and his involvement is not direct but on the strength of the confessional statement of the driver of the vehicle in question, he is likely to be implicated, this Court recording the objection of the State, is inclined to direct him to surrender before the learned court below to go on bail instead of entertaining plea for pre-arrest bail as has been demanded. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL is disposed of with the direction as aforesaid. It is further directed that in the event, the petitioner surrenders before the court of learned J.M.F.C., Barpali in connection with Barpali P.S. Case No.55 of 2026 corresponding to G.R. Case No.54 of 2026 within a fortnight from today, he shall be released on bail upon furnishing a bail bond of Rs.20,000/-(rupees twenty thousand) with one solvent surety for the like amount with such other conditions imposed as deemed proper in the facts and circumstances of the case. 6.
