05. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode). 2. Since these two bail applications arise out of one and same case record, the same are heard together and disposed of by this common order with the consent of the learned counsel for the parties. 3. These are the bail applications U/S.483 of BNSS by the petitioners for grant of bail in connection with Badagad PS Case No. 20 of 2023 corresponding to CT case No. 38 of 2023 pending in the file of learned JMFC-IV, Bhubaneswar for commission of offences punishable U/Ss. 419/420/467/468/34 of the IPC, on the main allegation of executing registered sale deed by resorting to impersonation and conspiracy. Heard, Mr. Suryakanta Dwibedi, learned counsel for the petitioners in BLAPL No. 2080 of 2026; Mr. Sidheswar Rath, learned counsel for the Petitioner in BLAPL No. 7012 of 2026 appearing virtually; Mr. R.B. Mishra, learned Additional Public Prosecutor and Mr. Satyabrata Dash, learned counsel for informant in BLAPL No. 2080 of 2026 in the matter and perused the record. 5. After having considered the rival submissions and taking into consideration the nature and gravity of the offences as alleged against the petitioners vis-à-vis the accusations sought to be brought against them and regard being had to the pretrial detention of the petitioners in custody since 25.01.2026 with submission of charge sheet in the meantime and taking into account the other circumstances on record in entirety including the inherent right of the accused-petitioners to be presumed innocent until proven guilty at the trial and there being no criminal antecedent reported against the Petitioner Bhagyarathi Sahoo and lastly, taking into account the status of the Petitioner Renuprava Satapathy as a lady and applying the first proviso appended to Sec. 480 of BNSS, this Court without expressing any view on merit admits the petitioners to bail. 6. Hence, these two bail applications of the petitioners namely Niranjan Satapathy @ Niranjana Satapathy, Renuprava Satapathy and Bhagyarathi Sahoo in BLAPL Nos.
2080 & 7012 of 2026 are allowed
and each of the petitioners is allowed to go on bail on furnishing bail bonds of Rs.50,000/- (Rupees Fifty Thousand) each with two solvent sureties for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper by it. 7. Accordingly, these BLAPL Nos. 2080 & 7012 of 2026 stand disposed of. Issue urgent certified copy of the order as per Rules. A soft copy of this order be immediately communicated to the concerned Court, who shall afterwards communicate the same to the concerned Jail through e-mail for reference. (G. Satapathy)
