2023. The FIR dated 03.07.2026 lodged by the mother of the victim reveals that her daughter, who was aged more than 18 years left her residence to meet her friend in a nearby area but the informant further stated that she tried to contact her daughter and her daughter was untraced till the next day of morning. At this, the informant informed the police officials of Dispur Police Station and the police apprised her that the police had traced her daughter along with the petitioner. The informant further stated that the petitioner had abducted her daughter and kept her at a different place and also that the petitioner had physically and mentally tortured her. It is also stated that the petitioner had produced a forged aadhar card in order to show that he is a Hindu person instead of a Muslim individual. 3. The learned Counsel for the petitioner submits that the petitioner and the daughter of the informant had a love relationship and out of the same, the daughter of the informant had gone with the petitioner on her own volition. He also submits that the daughter of the informant knew the petitioner was from a Muslim community as her messages with the petitioner demonstrated. 4. Mr. D.P. Goswami, learned Additional Public Prosecutor for the State submits that it is stated in the FIR that the petitioner had forged his aadhar card to show that he is a boy of Hindu community.
He also submits that the petitioner had abducted the daughter of the informant and had kept her in a separate place with an ill motive as has been stated in the FIR. 5. Upon consideration of the submissions made by the learned Counsels, more so, in view of the fact that the daughter of the informant is above 18
Page No.# 3/3 years of age and she went herself to meet her friend at 08:30 pm on 02.07.2026 and also due to the fact that the messages exchange between the petitioner and the daughter of the informant shows that they are in relationship, this Court finds it fit to enlarge the petitioner on bail on furnishing of bail bond of Rs. 20,000/- with local surety of the like amount to the satisfaction of CJM, Kamrup(M) under the following conditions:
i) the petitioner will not approach the daughter of the informant at any point of time. ii) the petitioner will appear before the Investigating Officer as and when call for. iii) the petitioner will not hamper, tamper with the evidence, neither influence the witnesses connected with the case. iv) the petitioners will not leave the place of jurisdiction without the permission of the said Court i.e. CJM, Kamrup(M). 6.
