Gogoi, learned counsel for the applicant. 2] This is an interlocutory application filed by the applicant seeking implement of opposite party No.5 as party respondent in the accompanying writ petition being WP(C) No.2896/2026. 3] The case projected by the petitioner in WP(C) No.2896/2026 is that the opposite party No.5 was his former spouse, whose name was entered into the service records of the petitioner as a nominee. Subsequently, in charges of murdering the mother of the petitioner the former spouse is undergoing through trial proceeding. The petitioner had divorced his spouse under the Muslim law who is the opposite party No.5. 4] Nevertheless, this Court is of the view that the opposite party No.5 is required to be arrayed as party respondent as the prayer in the writ petition was to strike off the name of the opposite party No.5 as a nominee in the service record of the petitioner and instead enter the name of the petitioner's father in the service record. The present applicant therefore, filed an interlocutory Page No.# 3/3 application for impleadment of the opposite party No.5 as respondent No.5. 5] Mrs. R. Devi, learned CGC does not object to the prayer made. 6] Accordingly, at this stage, without issuing notice, this interlocutory application stands allowed. The opposite party No.5 namely Salma Jahan Ahmed is arrayed as party respondent No.5 in WP(C) No.2896/2026. 7] The respondent No.5 in WP(C) No.2896/2026 will not be prejudiced as she will have ample opportunity to file objections and affidavits in the accompanying writ petition being WP(C) No.2896/2026 during the proceedings pursuant to her impeachment as party respondent No.5. 8] The petitioner will file amended cause title within one week from today and thereafter the writ petition be listed. 9] This interlocutory application accordingly, stands disposed.
