Since petitioner No.1 was arrested in the meantime, ABLAPL as against him has become infructuous and accordingly dismissed. 2. Heard learned counsel for the petitioners and State. 3. Instant petition under Section 482 BNSS is filed seeking pre-arrest bail of the petitioners in connection with Sinapali P.S. Case No.27 of 2026 corresponding to S.A. Case No.215 of 2026 pending in the file of learned Additional District Judge-cum-Special Judge, Khariar on the grounds stated. 4. Perused the FIR as at Annexure-1. The Court finds that a case has been registered for the offences punishable under Section SC & ST (PoA) Act. Recorded the submission of learned counsel for the petitioners and objection of the State. Considering the nature of allegations revealed from the FIR and the alleged involvement of the petitioners, this Court is inclined to direct them to surrender before the learned court below seeking regular bail for its consideration in the light of the decision of this Court in Pramod Kumar Ray and others Vrs. State of Odisha (2017) 67 OCR 309. 5. Accordingly, it is ordered. 6. In the result, the ABLAPL is disposed of with the direction as aforesaid. In the event, the petitioner Nos.2 and 3 surrender before the court of learned Additional District Judge- cum-Special Judge, Khariar within a fortnight from today and move applications for bail, it shall be considered in connection with Sinapali P.S. Case No.27 of 2026 corresponding to S.A. Case No.215 of 2026 and disposed of as per the decision in Pramod Kumar Ray (supra) with a proper notice to the informant and till their surrender, it is directed that they shall not be arrested by the local PS. 7.
