1. Heard learned counsel for the petitioners and State.
2. Instant petition has been filed under Section 482 BNSS by the petitioners seeking pre-arrest bail in connection with Kamakhya Nagar P.S. Case No.76 of 2026 corresponding to G.R. Case No.131 of 2026 pending in the file of learned S.D.J.M., Kamakhyanagar on the grounds stated.
3. Perused the FIR as at Annexure-1. It is submitted that the petitioners do not have any previous antecedent. It is claimed that the recovery and seizure of the laterite stones while being transported allegedly in a vehicle was made in absence of the petitioners. From the report, it is made to understand that the accused persons managed to flee from the spot. It is claimed that petitioner No.1 is the owner of the alleged vehicle and petitioner No.2 is his friend, whereas, petitioner No.3 is the diver of the same. Considering the alleged seizure of the laterite stones with the vehicle and recording the
claim that the petitioners do not have any previous criminal record and one of them, namely, petitioner No.1 being the owner of the vehicle in question, this Court recording the objection of the State, though not in favour of entertaining their plea for pre-arrest bail but is of the view that all should be
directed to surrender before the learned court below for being released with stringent conditions.
4. Accordingly, it is ordered.
5. In the result, the ABLAPL is disposed of with the direction as aforesaid. It is further directed that in the event, the petitioners surrender before the court of learned S.D.J.M., Kamakhyanagar in connection with Kamakhya Nagar P.S. Case No.76 of 2026 corresponding to G.R. Case No.131 of 2026 within a fortnight from today, they shall be released on bail upon furnishing a bail bond of Rs.30,000/-(rupees thirty thousand) each with one solvent surety for the like amount each with such other conditions imposed besides the following, such as, they shall not involve themselves in any such criminal activities while on bail and to report the IO as and when summoned for the purpose of investigation, till its completion. The above order, as is further directed, shall not be given effect to if any of the petitioners is having criminal antecedent of similar nature.
6. Issue urgent certified copy of this order as per rules.
