JUSTICE R.K. PATTANAIK Order No. ORDER 21.04.2026 01. 1. Heard learned counsel for the petitioner and State. 2. Instant petition has been filed under Section 482 BNSS by the petitioner seeking pre-arrest bail in connection with Rajnagar P.S. Case No.411 of 2025 corresponding to G.R. Case No.539 of 2025 pending in the file of learned NGN-cum- J.M.F.C., Rajnagar on the grounds stated. 3. Perused the FIR as at Annexure-1. It is submitted that the name of the petitioner is not mentioned in the FIR. It is further submitted that another accused, namely, Biswajit Swain is on bail and hence, petitioner since is similarly situated like him and therefore, should be allowed to go on bail applying parity. A copy of the bail order dated 29th January, 2026 in respect of the co-accused above named in ABLAPL No.15 of 2026 is produced at the time of hearing. The case diary and other relevant documents are produced by learned counsel for the State. The PM report is also made available and death is due to Dilated Cardiomyopathy and its complication thereof stated to be natural death process. Considering the post-mortem report and order in the ABLAPL in respect of the co-accused, the petitioner since found to be on equal footing, this Court is inclined to extend parity directing his release upon surrender before the learned court below subject to conditions. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL is disposed of with the direction as aforesaid. It is further directed that in the event, the petitioner surrenders before the court of learned NGN-cum- J.M.F.C., Rajnagar in connection with Rajnagar P.S. Case No.411 of 2025 corresponding to G.R. Case No.539 of 2025 within fifteen days from today, he shall be released on bail upon furnishing a bail bond of Rs.30,000/-(rupees thirty thousand) with one solvent surety for the like amount with such other conditions imposed besides the following, such as, he shall report the IO for the purpose of investigation as and when necessary. 6.
