Panda, ASC CORAM: MR. JUSTICE R.K. PATTANAIK Order No. ORDER 21.04.2026 01. 1. Heard learned counsel for the petitioner and State. 2. Instant petition has been filed under Section 482 BNSS by the petitioner seeking pre-arrest bail in connection with Baripada Sadar P.S. Case No.018 of 2026 corresponding to C.T. Case No.100 of 2026 pending in the file of learned S.D.J.M., Baripada on the grounds stated. 3. Perused the FIR as at Annexure-1. The Court finds that the alleged mischief was committed by the petitioner and others during the incident against a Bangladeshi national, who said to have been criminally intimidated for the reason stated. It is submitted by Mr. Rout, learned counsel for the petitioner that all the offence are bailable in nature except the one under Section 196 BNSS. The details of the alleged incident stand narrated in the report. It is alleged that some of the members of the Bajrang Dal did the excess. The investigation is stated to be in progress. Considering the involvement of a group of men and the petitioner being one among them and said to have committed the overt acts involving the victim, this Court, recording the objection of the State, is inclined to direct him to surrender before the learned court below for being released instead of entertaining his plea of pre-arrest bail. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL is disposed of with the direction as aforesaid. It is further directed that in the event, the petitioner surrenders before the court of learned S.D.J.M., Baripada in connection with Baripada Sadar P.S. Case No.018 of 2026 corresponding to C.T. Case No.100 of 2026 within a fortnight from today, he shall be released on bail upon furnishing a bail bond of Rs.20,000/-(rupees twenty thousand) with one solvent surety for the like amount with such other conditions imposed as deemed just and proper in the facts and circumstances of the case. 6.
