Petitioner seeks quashing of FIR No. 378/2025 dated 13.06.2025, registered at Police Station Binda Pur, for commission offences under Sections 290/106(1) of Bharatiya Nyaya Sanhita, 2023 (corresponding Sections 288/304A IPC), on the basis of settlement. 2. There is already a Memorandum of Understanding (MoU) dated 12.12.2025 between petitioner and respondent no. 2. 3. Aforesaid FIR was registered on the basis of complaint made by Smt. Renu Devi (respondent no. 2 herein), whose husband died in the incident in question while he was working as labourer at one property situated at Matiala Village, Delhi. 4. In terms of the aforesaid directions, status report has been shown and the same is directed to be taken on record. 6. As per such status report, deceased is survived by his wife, four daughters and three sons. All such legal heirs have been contacted and their statements have been recorded and they all have stated that they would have no objection to the quashing of FIR in question and they have also given their consent with respect to the terms and conditions as mentioned in the MoU dated 12.12.2025. 7. Petitioner is present in Court. 8. Respondent No.2 is also present in Court alongwith with her one son-Mr. Dilip Patel and has been duly identified by Investigating Officer. 9. When asked, she reiterated that matter has been amicably settled and that she has entered into settlement voluntarily, without any pressure, force, coercion or undue influence from any corner whatsoever. 10. Deceased-Satya Narain was working as labourer and was repairing a tin-shed roof and during such repair, he fell down and, consequently, suffered fatal injuries. The MoU mentions that roof was being repaired by him on 12.06.2025, when it was extremely hot and that he fell down on account of some dizziness. Though, as per averments in the instant FIR, the worker had died as there were no safety measures at the site, but Renu Devi, widow of aforesaid worker submits that there is amicable settlement and, therefore, she does not want to proceed with the aforesaid case. The petitioner has agreed to give compensation of Rs. 4,50,000/- and such amount has been received by her today by way of Demand Draft dated 17.03.2026 drawn on Karnataka Bank Ltd., Dwarka, New Delhi. Renu Devi as per ‘no objection’ given in this regard by her sons and daughters. 11. Charge-sheet has already been filed. 12. In view of the settlement arrived at between the parties, continuing with criminal proceedings would serve no useful purpose. 13. Accordingly, exercising inherent powers vested in this Court under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023, it is deemed appropriate to quash the instant FIR. 14. Consequently, to secure the ends of justice FIR No. 378/2025 dated 13.06.2025, registered at Police Station Binda Pur, for commission offences under Sections 290/106(1) of Bharatiya Nyaya Sanhita, 2023 (corresponding Sections 288/304A IPC), along with all consequential proceedings arising therefrom, is, hereby, quashed. Original affidavits of the parties, copies of which have been placed on record in the present proceedings, shall be submitted before the learned Trial Court within two weeks from today, so that these become part of Trial Court Record. 15.
