It is submitted by learned counsel for the petitioner that the Gram Sabha of Panchayat Block Hillour, falling in Tehsil Drabshalla, District Kishtwar, had recommended opening of a fair price shop for sale of ration at a designated site offered by the petitioner in the year 2023, which has been sent to the respondents for consideration and passing of appropriate orders. However, the respondents are sitting over the representation, thereby denying the people of the area of the fruits of a fair price shop which the department has opened in various places. 2. Issue notice. 3. Mr. Deewakar Sharma, learned Dy. AG waives notice on behalf of the respondents and claims that the Government has already taken a policy decision and set Serial No. 143 Supplementary List WP(C) No. 2075/2026 parameters on the basis of which evaluation is to be made as to whether a particular area requires such a shop, depending upon the number of souls residing therein who are entitled to receive ration through such fair price shop. 4. He further submits that the representation was made in the year 2023 and since then the petitioner has remained silent. 5. Be that as it may, since the petitioner seeks consideration of his representation, it is for the respondents to take a decision on the representation made by the petitioner. 6. Having heard both the counsel and without determining the merits of the case, this petition is disposed of treating the same as representation, a copy whereof shall be laid by the petitioner before the office of respondent No. 2 who shall consider the same in accordance with law after obtaining a report from the field staff and also examining the eligibility of the petitioner. A decision thereof shall be taken within a period of three months from the date of passing of this order. 7. Disposed of.
