The petitioner has filed this CRLMC with a prayer to waive out the condition imposed by the learned Executive Magistrate, Tirtol for executing the bond of Rs.20,000/- with two Govt. Surety for the like amount to keep peace a period of one year/three year in Crl. Misc. Case No.64 of 2026. 3. Learned counsel for the petitioner submits that pursuant to the summon issued by the learned Executive Magistrate, Tirtol, the Petitioner appeared before Executive Magistrate. On 26.05.2026, the Petitioner moved a petition for enlarge him on bail keeping with the PR Bond. But, the learned Executive Magistrate, Tirtol has not accepted the petition to release him on bail as the conditions imposed against the petitioner were not fulfilled. He further submits that the condition imposed by the learned Executive Magistrate, Tirtol upon the petitioner is causing hardship to arrange Govt. Surety. 5. Learned counsel for the State opposes the prayer made by the petitioner. 6. Considering the submissions made by petitioner and the learned counsel for the State and on going through the averments made in this petition, the order dated 14.05.2026 passed by the learned Executive Magistrate, Tirtol is dispensed with and modified. The learned Executive Magistrate, Tirtol is directed to release the petitioner on bail by accepting the PR bond. 7. It is further observed that the learned Executive Magistrate, Tirtol has not even learnt how to put the date in the notice in clear terms.
