CMP(M) No.2070 of 2025 Present application has been filed by the petitioner for condonation of delay in filing the present petition. As per the averments as made in the application, the impugned order dated 10.11.2025 was passed by the learned Additional District Judge, Sarkaghat, District Mandi, H.P and though the certified certified copy of the judgment was applied by the counsel well-in-time, however, the same was mis-placed in the office of the counsel and on this account, delay has occurred in filing the present petition. Mr. Ajay Chandel, learned counsel for the respondents vehementally opposed the application and stated that no averments have been made in the application in order to make out the case for condonation of delay. From the perusal of the application, it reveals that though the certified copy of the impugned judgment was applied, however, the same was mis-placed in the office of the the counsel and in that process, delay has occurred in filing the present petition.
Keeping in view the averments as made in the application, which is duly supported by an affidavit and in view of the submissions as made by the learned counsel for the applicant/petitioner, the application is allowed and the delay of 110 days in filing of petition is condoned. Petition be registered. Application stands disposed off. Civil Revision No._____ CRST No.39385 of 2025 At the request of learned vice counsel appearing for the petitioner, list the matter after two weeks. In the meantime, learned counsel for the petitioner is directed to supply the entire paper book of the case to the respondent.
