JUSTICE ADITYA KUMAR MOHAPATRA ORDER 31.07.2026 Order No. 02. 1. This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode). 2. Heard learned counsel for the Petitioner as well as learned Addl. Standing Counsel for the State. Perused the CRLMC application as well as the prayer made therein. 3. By filing the present application the accused-petitioner in Binka P.S. Case No.181 of 2025 which corresponds to Special G.R. Case No.67 of 2025 pending in the Court of learned Sessions Judge-cum- Special Judge, Sonepur has approached this Court for quashing of the charge-sheet dated 01.03.2026 and order taking cognizance dated 06.03.2026. 4. Learned counsel for the State at this juncture contended that in the meantime, after filing of the charge-sheet against the present Page 2 of 2. petitioner along with other accused persons charge has been framed. 5. In view of the aforesaid position, this Court deems it proper to dispose of the present CRLMC application by granting liberty to the Petitioner to raise all the grounds taken in the present application along with any other ground available to the Petitioner by filing a discharge petition. In the event any such discharge application is filed within two weeks’ from today the same shall be considered strictly in accordance with law after providing an opportunity of hearing to the accused- petitioner and such discharge petition shall be disposed of by passing a reasoned order as expeditiously as possible preferably within a period of eight weeks from the date of communication of a copy of today’s order. 6.
