Instant petition has been filed under Section 482 BNSS by the petitioner seeking pre-arrest bail in connection with Padmapur P.S. Case No.65 of 2022 corresponding to T.R. Case No. 69 of 2022(A) pending in the court of learned Addl. Sessions Judge-cum-Special Judge, Gunupur on the grounds stated. 3. Perused the FIR as at Annexure-1. Mr. Ray, learned counsel for the petitioner submits that there is an acquittal order in respect of another accused, namely, Prasant Majhi as per Annexure-2. It is submitted that the petitioner was not present at the spot and nothing has been whispered against him during trial by the IO, hence, he should be allowed to go on bail with conditions. Recorded the objection of the State. The petitioner had earlier approached this Court in ABLAPL No. 8910 of 2024 disposed of on 29th August, 2024. In view of the above and earlier rejection of the ABLAPL, this Court is not inclined to reconsider the plea of pre-arrest bail, however, grants liberty for the petitioner to surrender before the learned court below and plead bail in view of the acquittal judgment as at Annexure-2 for orders. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL is disposed of with the direction as aforesaid. It is further directed that in the event, the petitioner surrenders within a fortnight from today and moves an application for bail in connection with T.R. Case No. 69 of 2022(A) arising out of Padmapur P.S. Case No.65 of 2022 pending in the Court of learned Additional Sessions Judge- cum-Special Judge, Gunupur, it shall be disposed of considering the plea based on Annexure-2 and on such other grounds as has been advanced at present. 6.
