The Petitioner is an accused in connection with T.R. Case No.20 of 2026 pending on the file of learned Sessions Judge -Cum- Special Judge, Kendrapara arising out of Kendrapara Excise Station No.194 of 2025-26 for commission of offences alleged under Sections 21(b) of NDPS Act. 3. Learned counsel, on instruction, submits that except the present BLAPL, no other bail application of the Petitioner relating to the aforementioned P.S. case is pending in any other Court. 4. Being aggrieved by the rejection of his application for bail U/s.483 of the Bharatiya Nagarik Suraksha Sanhita (BNSS) by the learned Sessions Judge-cum-Special Judge, Kendrapar by order dated 18.02.2026 in the aforementioned cases, the present BLAPL has been filed. 5. The allegation against the Petitioner pertains to the seizure of 50 grams of Diacetyl Morphine. It is submitted that, since the quantity is less than commercial quantity and the charge sheet has already been filed on 07.04.2026, the Petitioner may be released on bail. 6. Learned counsel for the State opposes the prayer for bail, inter alia, on the ground that the Petitioner has criminal antecedent. 7. Taking into account the nature of the accusation, filing of the charge sheet and that the Petitioner is in custody since 12.02.2026, this Court directs the Petitioner to be released on bail on such terms to be fixed by the learned Court in seisin so as to ensure his presence during the trial subject to verification of not more than two antecedents of any nature. If it comes to the fore that the Petitioner has more than two criminal antecedents, this order shall not be given effect to. 8. Accordingly, the BLAPL stands disposed of. 9.
