Present appeal has been filed under Section 14-A of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989, seeking anticipatory bail in FIR No.448, dated 18.09.2025, under Sections 115(2), 333, 324(4), 351(2) of BNS, 2023, and Sections 3, 33, 89 of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989, registered at Police Station Mujesar, District Faridabad.
2. Briefly, the facts of the case are that complainant Rohit informed the police that on 15.09.2025 he had an altercation with Vijay over drain. Thereafter on the intervening night of 15/16.09.2025 he was at his house. Suraj and Rahul and one more boy abused him with caste oriented abuses. They also tried to broke the door of his house. But when they failed to do so, they came inside the house of the complainant by tearing the roof sheet. They gave threat of death to the complainant. The above occurrence took place on the intervening night of 15/16 at about 1 A.M. The assailants RAJAN 2026.07.10 15:26 I attest to the accuracy and integrity of this document

broke the television lying in the house of complainant. The assailants also took away Rs.20,000/- lying in the house of complainant. On the basis of aforesaid complaint case under sections 115(2), 333, 324(4), 351(2) BNS & 3, 33, 89 SC/ST Act was registered.

Learned counsel argues that no offence under Sections 3, 33, 89 of SC/ST Act is made out against the appellant - Suraj Patil because nowhere it has been alleged that any caste oriented abuses were given by the accused persons to the complainant/respondent No.2. While referring to the
order dated 22.06.2026, reproduced below, he submits that the appellant has already joined investigation and has fully cooperated with the Investigating Agency:
“Notice of motion, returnable for 09.07.2026. Mr. Shashank Bhandari, Addl. A.G., Haryana, who on advance notice is present in Court, accepts notice on behalf of respondent-State. He seeks time to address the
arguments. In the meanwhile, petitioner is directed to join investigation forthwith as and when so directed by Investigating Agency and in the event of arrest shall be released on interim bail on furnishing of bail bonds to the satisfaction of SHO/Investigating Officer/Arresting Officer.”
4. Learned State counsel has filed reply by way of affidavit of Pankaj Kumar, HPS, Assistant Commissioner of Police, Mujesar, Faridabad, in Court today. Same is taken on record. Mr. Birender Bikram Attrey, learned Additional Advocate General, Haryana, endorses the statement of the petitioner’s counsel as correct and submitted that as of now, custodial interrogation of the appellant is not required for the purpose of investigation.
5. Heard learned counsel for the parties.
6. Since, appellant has already joined the investigation and custodial interrogation is no more required, ad-interim bail order dated 22.06.2026 passed by the coordinate Bench is hereby made absolute.
7. Accordingly, present appeal is allowed.
8. However, appellant shall continue to join the investigation as and when required to do so and abide by all the terms and conditions laid down under Section 482(2) of BNSS, 2023. ( Sanjay Vashisth )
