Brahma, ASC CORAM: MR. JUSTICE R.K. PATTANAIK Order No. ORDER 20.05.2026 03. 1. Heard learned counsel for the respective parties. 2. Instant petition under Section 482 BNSS is filed for pre-arrest bail of the petitioners in connection with Baseli Sahi P.S. Case No. 41 of 2026 corresponding to G.R. Case No. 155 of 2026 pending in the file of learned J.M.F.C-II (Cog. Taking), Puri on the grounds stated therein. 3. Perused the FIR as at Annexure-1. This Court by order dated 16th April, 2026 had directed the State to take instructions regarding the settlement reached at between the parties, which was claimed by the petitioners. Today, it is submitted by Mr. Brahma, learned ASC for the State that no such instruction has been received. Mr. Goswami, learned counsel for the petitioners submits that there is payment of Rs. 6 lac after the settlement with the other accused, namely, Sarmistha Pattajoshi. It is claimed that the negotiation is still going on at present, with regard to the balance amount of Rs.4 lac. In support of the compromise, a document style as ‘Samadhan Patra’ is referred to. Along with the said document, a copy of the Demand Draft for an amount of Rs.2.5 lac is submitted for the Court’s perusal in proof the payment after a settlement between the parties. Considering the above facts and recording the submissions of learned counsel for the respective parties as there has been substantial payment made by the accused to the informant so claimed, this Court is inclined to direct the petitioners to surrender before the learned court below for being released with suitable conditions imposed even though their bail plea is not entertained. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL petition stands disposed of with a direction as aforesaid. In the event, the petitioners surrender before the court of learned J.M.F.C-II (Cog. Taking), Puri in connection with G.R. Case No. 155 of 2026 within a period of three weeks from today arising out of Baseli Sahi P.S. Case No. 41 of 2026, it is directed that they shall be released on bail on furnishing a bail bond of Rs.40,000/- (rupees forty thousand) each with one solvent surety for the like amount each to the satisfaction of the court below, which shall be at liberty to impose such other suitable conditions as deemed just and proper in the facts and circumstances of the case. 6. 6.
